1. Seller Identity: The owner of the website www.tibetshopmilano.com and seller of the products contained therein is the company Tamang Wangdi with registered office in Piazzale Maciachini 22 or Show Room in via Carlo Farini 58 (MI) – Italy. After verifying availability, the order is processed and shipped usually within three working days, unless otherwise indicated, delivery will be by express courier to the address provided in the order.

2. Scope of Application

The general conditions of sale are governed by Italian law and, in particular, by Legislative Decree 70/2003 concerning electronic commerce and by Legislative Decree 206/2005 with specific reference to the legislation on distance contracts.

With particular reference to Title III "Contractual Modalities", Chapter II "Particular modalities for concluding the contract", Section II "Distance Contracts"; Legislative Decree no. 70 of 09/04/2003, "Implementation of EC Directive no. 31/2000 on Electronic Commerce"; Legislative Decree no. 114 of 31/03/1998, "Reform of the discipline relating to Commerce") govern all purchase contracts concerning products for sale on the website www.tibetshopmilano.com and concluded according to the methods described herein.

These General Conditions of Sale shall be expressly accepted by anyone who proceeds with an online purchase. The Customer declares to have read all the information provided during the purchase procedure, and to accept these General Conditions of Sale fully and unconditionally. The submission of the purchase request implies full knowledge and unconditional acceptance of these General Conditions of Sale.

These General Conditions may be modified by Tamang Wangdi without prior notice.

Each contract will be governed by the General Conditions of Sale in force at the time of the Customer's order submission.

 

3. Conclusion of the contract

In order to complete a purchase order, the User must first register as a Customer on the website www.tibetshopmilano.com, providing information useful for invoicing and delivery. This data, which will be processed in accordance with the Privacy Law (Law 196/2003), can be modified by the Customer at any time. Registration does not in any way oblige to purchase; the user who, after registering, intends to proceed with a purchase, must follow the procedure indicated by the IT system.

The purchase contract stipulated between the Customer and Tamang Wangdi is understood to be concluded with the acceptance, even partial, of the Customer's order by Tamang Wangdi. Final acceptance is expressed by means of a confirmation email sent to the email address indicated by the Customer during registration. From that moment on, the order is registered in our system and will subsequently be processed by our Staff. There is a possibility, in the time between the registration of your order and its fulfillment, that the product may no longer be available.

In such a case, our Staff will undertake to order the product (average procurement times 20 days) and then proceed with its shipment. If the product is no longer available, our staff will endeavor to promptly contact you to inform you of the product's unavailability and to refund you if payment has already been made. The confirmation message will include the date and time of the order and a "Customer Order Number", to be used for any further communication with Tamang Wangdi. The message reiterates all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described.

In the event of non-acceptance of the order, Tamang Wangdi guarantees timely communication to the Customer, and in any case within 7 days of receiving the order.

Any right of the Customer to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order, is excluded.

Once the online purchase procedure is completed, the Customer will print or save an electronic copy of their order and its confirmation and, in any case, keep the current General Conditions of Sale.

For every order placed, Tamang Wangdi issues a fiscal receipt for the shipped material; the receipt will be transmitted together with the goods or by email or paper. For the issuance of the invoice, the information provided by the Customer at the time of the order will be valid. No changes to the invoice will be possible after its issuance.

 

4. Object of the contract and online catalog

The object of these General Conditions of Sale are the products present in the online catalog of the website www.tibetshopmilano.com. Unless otherwise agreed in writing, the Customer can only purchase the products present and available in this catalog at the time of placing the order. Tamang Wangdi reserves the right to vary, without any prior notice, the product catalog and its price lists. If one of the requested products is not available, Tamang Wangdi undertakes to contact the Customer within 7 days from the time of placing the order, communicating by e-mail the unavailability and any alternative solutions.

In this case, the Customer may wait for the delivery of the order, if Tamang Wangdi considers, at its sole discretion, that it can find the unavailable product on the market, opt for another product, to which the relative prices and rates will apply, or cancel the order obtaining a full refund of the price already paid.

All products offered for sale are analytically described (quality, characteristics, price) in the specific online catalog of the website www.tibetshopmilano.com. The product sheet for each product indicates the retail price, including VAT. Further and any additional costs (shipping costs, transaction fees and/or insurance of the goods) will be displayed in total before placing the order.

The image possibly accompanying the product description sheet has a purely descriptive value and may not coincide with the real characteristics of the item, but may differ in color, dimensions, or accessory products shown in the figure. The color of the item may appear different from that represented on your computer monitor also due to the particular calibration configured by the PC user. All supporting information for purchase is to be understood as simple generic informative material, not referable to the real characteristics of a single product.

 

 

5.Customer.

payment can be made using credit or prepaid cards through the Paypal circuit.

For this type of payment, Tamang Wangdi does not require any additional percentage to the value of the transaction.

The security of online payment is managed by Paypal's centralized servers.

6. Delivery methods and costs

Tamang Wangdi exclusively accepts orders for delivery within Italian territory. However, delivery to the localities of Livigno, Campione d'Italia, and the Republic of San Marino is excluded. For each fulfilled order, Tamang Wangdi issues a fiscal receipt accompanying the shipped material, and upon written request, it can be sent via e-mail to the order holder, pursuant to art. 14 D.P.R 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of registration on the site will be valid. No changes to the invoice will be possible after its issuance.

Upon receipt of the order and related payment, Tamang Wangdi will arrange for shipment by carrier, if the product is available in stock. If the product is not available, Tamang Wangdi will inform the Customer of the procurement times. Not all products published on the www.tibetshopmilano.com portal are available in stock.

From the moment the product is shipped from our warehouses, delivery time is generally 2/3 working days. For bulky, large, or heavy products, delivery takes approximately 8/10 working days. For shipments to Calabria, Sicily, and Sardinia, the estimated delivery time is approximately 10/12 working days. Should the Customer opt for an insured shipment, the goods may travel by express courier or professional forwarder; such a shipment may require longer delivery times than those indicated above.

Product delivery is understood to be curbside, unless:

* different communication to our customer service (wangdut@hotmail.com)

Upon delivery of the goods by the carrier, the Customer is required to check:

* that the number of packages delivered corresponds to what is indicated in the transport document or accompanying invoice

* that the packaging is intact, not damaged, wet or otherwise altered, including the sealing materials (adhesive tape or metal straps)

Any damage to the packaging and/or product or discrepancy in the number of packages or indications must be immediately contested by adding a WRITTEN CHECK RESERVATION (specifying the reason for the reservation: "holed packaging", "crushed packaging", etc.) on the carrier's proof of delivery. Once the carrier's document has been signed, the Customer will not be able to raise any objection regarding the external characteristics of what has been delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 calendar days of delivery, according to the procedures provided in this document.

In case of failure to collect, within 5 working days, the material stored in the carrier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be automatically cancelled, the goods will be returned to Tamang Wangdi's warehouses and the related transport costs will be borne exclusively by the Customer.

The goods travel at the buyer's expense and risk. The seller is not responsible for delays, losses, thefts and/or damages caused by the shipping methods and/or the inconveniences arising therefrom.

Value reimbursed in case of damage by the carrier:

* uninsured shipments: in case of damage, the carrier reimburses 1 euro/kg calculated on the weight of the product, in accordance with current legislation (Legislative Decree 286/2005)

* insured shipments (involve an extra cost for the Customer): the entire cost of the purchased product is reimbursed. In this case, the goods may travel by express courier; this shipment may require longer delivery times.

The Customer can choose between the two shipping methods by selecting the relevant item in the shipping method menu during the order confirmation phase. The system will automatically update the rate based on the product's dimensions and the final destination of the goods.

In the event of damage to the goods by the carrier, Tamang Wangdi will take care of the management of the

refund process, which can only be initiated once the damaged goods have been received.

Following the return of the damaged goods to Tamang Wangdi's warehouses, the Customer will have the right to:

in case of insured shipping

* cancel the order and receive a refund from Tamang Wangdi equal to the value of the order placed.

* request the shipment of a new product identical to the previous one or different, by paying the difference between the order amount and the amount subject to refund. The new product will be promptly shipped upon receipt of payment, subject to stock availability (if the product is not available, Tamang Wangdi will communicate the procurement times).

in case of uninsured shipment

* cancel the order and receive a refund from Tamang Wangdi equal to 1 euro/kg calculated on the weight of the product, as established by Legislative Decree 286/2005

* request the shipment of a new product identical to the previous one, by paying the difference between the order amount and the amount subject to refund. The new product will be promptly shipped upon receipt of payment, subject to stock availability (if the product is not available, Tamang Wangdi will communicate the procurement times).

Shipping Costs

These costs vary depending on the selected product, the destination area, and the type of shipment (insured or uninsured). For an immediate calculation, simply add the desired goods to the cart, select the type of shipment (insured or uninsured): the system will automatically calculate the final costs. For an exact calculation, we suggest Customers register on the portal, allowing the system to immediately identify the destination through the postal code.

In the event that the carrier used for the shipment provides a tracking number for it,

8. Right of Withdrawal Definitions:

* Consumer Purchaser: a natural person who purchases goods for purposes unrelated to any entrepreneurial activity carried out.

Tamang Wangdi will have the right to withdraw from the contract, in whole or in part, by written communication to be sent to the Purchaser by e-mail. The Purchaser will not be entitled to receive any compensation for damages possibly deriving from Tamang Wangdi's withdrawal.

The purchaser has the right to withdraw from the contract with Tamang Wangdi without any penalty and without specifying the reason, within 10 working days from the receipt of the goods.

– Methods for exercising the right of withdrawal by the Purchaser –

The right of withdrawal is exercised by sending, within the aforementioned term of 10 working days, a written communication to Tamang Wangdi by registered letter with acknowledgment of receipt. For this purpose, it is possible to use electronic mail, provided that the communication is confirmed by registered letter with acknowledgment of receipt within the following 48 hours. The registered letter is considered to be sent within the useful time if delivered to the accepting post office within 10 working days from the delivery of the goods.

Following written communication from the Purchaser (registered letter with acknowledgment of receipt), Tamang Wangdi will send confirmation of withdrawal by email to the address indicated in the order. – Execution of the right of withdrawal by the Purchaser –

The right of withdrawal will be considered regularly and correctly exercised by the Purchaser only and exclusively if carried out in compliance with the aforementioned deadline and the described communication method.

Upon receipt of the withdrawal communication, the parties are released from their respective obligations arising from the purchase order. If the products have been delivered, the consumer is obliged to return them within ten working days from the date of receipt of the goods. For the purpose of the expiry of the term, the goods are considered returned when they are delivered to the accepting post office or to the courier. – Return of goods subject to the right of withdrawal by the Purchaser –

The only costs owed by the consumer for exercising the right of withdrawal are the direct costs of returning the goods to the sender. It is recommended to take care of the packaging in order to avoid damage during return transport and to apply relative shipping insurance. Tamang Wangdi is not responsible for any damage and loss of goods returned without insurance.

The goods must be returned to the registered office in Piazzale Maciachini 22 Milan (MI), or to an operational office indicated in the Withdrawal Confirmation email.

– Methods of reimbursement to the Purchaser –

In case of withdrawal exercised by Tamang Wangdi and in case of payment already received, Tamang Wangdi will proceed to return the same plus legal interest. To this end, upon request of Tamang Wangdi, the Purchaser must indicate their bank details.

In case of withdrawal exercised by the Purchaser, Tamang Wangdi will refund what was paid by the same, by credit transfer. To this end, the Purchaser must indicate their bank details within the written communication of the right of withdrawal.

If the right of withdrawal is correctly exercised by the consumer, Tamang Wangdi will refund the value of the previously purchased goods. The refund is free of charge, in the shortest possible time and in any case within 30 days from the date on which Tamang Wangdi became aware of the consumer's exercise of the right of withdrawal. The sums are considered refunded within the terms if they are actually returned, shipped or re-credited with a value no later than the expiry of the previously indicated term. – Necessary conditions for exercising the right of withdrawal –

The right of withdrawal is however subject to the following conditions:

* The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.

* The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging)

* According to law, shipping costs for returning the product are borne by the Purchaser. The goods travel at the risk and expense of the Purchaser until they return to Tamang Wangdi's warehouses. Tamang Wangdi recommends insuring the shipment. Tamang Wangdi is not responsible for delays, losses, thefts and/or damages caused by the shipping methods.

* In the event of delays, loss, theft and/or damage caused by shipping methods, the right of withdrawal cannot be exercised. Tamang Wangdi will inform the customer of the incident (within 5 working days from receipt of the goods at its warehouses or from notification of an anomaly by the carrier). The Buyer will thus be able to promptly file a complaint against the carrier chosen by them and obtain a refund for what happened; in this event, the product will be made available to the customer for its return, simultaneously with the cancellation of the withdrawal request.

* Upon return of the goods to the warehouse, they will be examined to assess the integrity of the original packaging and its completeness, as well as any damage or tampering with the goods themselves. If the packaging and/or original packing is not intact or incomplete, or if the goods are damaged or tampered with, Tamang Wangdi reserves the right to withhold the costs necessary for their restoration or replacement.

If all the provisions established in these general conditions of sale concerning the correct and regular exercise of the right of withdrawal are not respected, the buyer-consumer does not have the right to obtain a refund of the sums paid as consideration for the purchase of the product. The buyer-consumer is, however, granted the faculty to obtain, at their own expense, the return of the same product originally delivered and subsequently returned by the buyer-consumer. In the event that the buyer-consumer does not intend to avail themselves of the aforementioned faculty, the exercise of which must be promptly communicated by sending an email to Tibet.italia@gmail.com, the supplier is entitled to retain the returned product and the sums already paid as consideration for the purchase of the product itself.

9. Warranties

All products sold by Tamang Wangdi are covered by the manufacturer's conventional warranty and by a 24-month warranty for conformity defects, pursuant to articles 128 et seq. of Legislative Decree no. 206/2005 (Consumer Code). To benefit from warranty assistance, the Customer must keep the invoice that they will receive via email in electronic format. The exercise of the Warranty may require assistance from Authorized Service Centers in the area as illustrated in the documentation included in the product packaging.

In any case, the manufacturer's conventional warranty is provided according to the methods illustrated in the documentation included in the product packaging.

The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that present a conformity defect, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the private Consumer (natural person who purchases the goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT number in the order form).

11. Privacy Protection

Pursuant to Legislative Decree no. 196/2003 (Code regarding the protection of personal data), which replaced law no. 675/1996, the processing of information concerning you will be based on principles of correctness, lawfulness and transparency and the protection of your privacy and your rights.

Pursuant to article 13 of Legislative Decree no. 196/2003 (formerly art. 10 of law 675/1996) of the aforementioned law, we therefore provide you with the following information:

The interested party also has the right to obtain confirmation of the existence or otherwise of personal data concerning them, even if not yet registered, and their communication in an intelligible form; consequently, they are in full possession of the rights listed below.

The Customer has the right to obtain an indication of:

* the origin of personal data

* the purposes and methods of processing

* the logic applied in case of processing carried out with the aid of electronic instruments

* the identification details of the data controller, data processors and the designated representative pursuant to article 5, paragraph 2 (see "About Us" paragraph)

* the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representative in the territory of the State, data processors or persons in charge of processing

The Customer has the right to obtain:

* the updating, rectification or, when interested, the integration of data

* the erasure, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed

* certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or involves a use of means manifestly disproportionate to the protected right

The Customer has the right to object, in whole or in part:

* for legitimate reasons to the processing of personal data concerning them, even if pertinent to the purpose of the collection

* to the processing of personal data concerning them for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication

12. Applicable law and competent court

The sales contract between the Customer and Tamang Wangdi is understood to be concluded in Italy and governed by Italian Law. For any dispute, if the Customer is a consumer, the territorial jurisdiction is that of the judge of the place of residence or domicile of the consumer, pursuant to art. 63 of Legislative Decree no. 206/2005 (Consumer Code); in all other cases, the territorial jurisdiction is exclusively that of the Court of Milan.
